[protofusion] Terms of Service
Prohibited uses include, but are not limited to utilizing your [protofusion] account and affiliated services for but not limited to the following:
Undertake or accomplish any unlawful purpose. This includes, but is not limited to, posting, storing, transmitting or disseminating information, data or material which is libelous, obscene, unlawful, threatening, defamatory, or which infringes the intellectual property rights of any person or entity, or which in any way constitutes or encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, federal or international law, order or regulation;
Post, store, send, transmit, or disseminate any information or material which a reasonable person could deem to be objectionable, offensive, indecent, pornographic, harassing, threatening, embarrassing, distressing, vulgar, hateful, racially or ethnically offensive, or otherwise inappropriate, regardless of whether this material or its dissemination is unlawful;
Access any other person's computer or computer system, software, or data without their knowledge and consent; breach the security of another user; or attempt to circumvent the user authentication or security of any host, network, or account. This includes but is not limited to Denial of Service attacks, brute force attacks, and other forms of malicious “hacking”
Use or distribute programs or other data created or used for compromising security, such as password guessing programs, decoders, password gatherers, unauthorized keystroke loggers, analyzers, cracking tools, packet sniffers (Ethereal will be disabled for all clients), encryption circumvention devices, or Trojan Horse programs.
Upload, post, publish, transfer, create derivative works of, or distribute in any way information, software or other material that is protected by copyright or other proprietary right, without obtaining permission of the owner. The former includes but is not limited to materials covered by the GNU and Creative Commons licenses.
Send bulk email messages or "spam." This includes any email with more than 30 recipients or that includes any form of advertising, petitions, chain messages, newsletters, and mailing lists. Special permission may be granted to an explicit group of users upon request. See section B1 for more information
All content posted on [protofusion] servers or displayed on pages originating from a [protofusion] server must comply by international copyright law
[protofusion] may remove copyrighted content from your site without prior notice
[protofusion]'s administrators may attempt to contact a user hosting copyrighted content to request the removal of such material, however such a notice is not guaranteed.
All [protofusion] logos shown on this site are the property of their respective creators within the site, and both the logos and the [protofusion] name are subject to regulation on [protofusion]'s servers
One may not use "[protofusion]" or "ProtoFusion" with any variation on capitalization to represent personal or commercial works on our servers or otherwise infer that an item content is created by the entity of [protofusion] itself while it truly is not.
One may not use the [protofusion] logo to represent or link to entities other than [protofusion] anywhere on [protofusion]'s services or hosted sites.
If one wants to VALIDLY use the [protofusion] logo on his or her hosted site, content, a internet or physical mailing, or any other form of communication originating from [protofusion]'s servrs, one must contact <admin@protofusion.org> with a written request and statement of how the logo or name will be used. The request will only be approved if it complies with the contents of sections C1 and C2 of this document.
All [protofusion] accounts found violating the terms of service may be terminated without warning. [protofusion] may also terminate an account on its sole discretion.
[protofusion] may erase your data and render it irrecoverable
[protofusion] may block you from accessing hosted services, both public and private, for any reason it deems necessary
Any account created for testing purposes in addition to accounts lacking content may be deleted at any time without prior notice
[protofusion] is not responsible for any incorrect or inaccurate content posted on any of [protofusion]'s websites or through any other part of the services provided by our servers. [protofusion] is not responsible for links to other websites that may be contained in the sites of clients nor the content of linked websites.
[protofusion] takes no responsibility of advertisements posted by third parties on any of our services nor any items or services offered by the advertiser.
[protofusion]'s services are provided "as is". Use [protofusion]'s services at your own risk. Although we strive to keep our services online and working, we take no responsibility for possible errors, damages, lost content, malfunction, or downtime.
[protofusion] disclaims all warranties of any kind and shall not be liable for any damages or losses whether directly or indirectly related to your use of this site, its services, or its content.
F. Exemption
Upon request, certain users may be able to receive services restricted by certain limitations stated in section A, although exemptions are exclusively for section A6, any other exemption will likely not be approved.
Obtaining exemption: Contact the system administrator <admin@protofusion.org> with subject “TOS Exemption” with your request.
Request limitations: All granted exemptions will be valid for 1 year from their issued date. Granted limitations only to apply to the particular sections of the Terms of Service stated in the exemption statement received in your email. All other violations of the TOS will be dealt with accordingly.
